User Agreement

1. Agreement to Terms

By accessing or using The Estimator ("Service"), you agree to be bound by this User Agreement, our Terms of Service, and our Privacy Policy. If you disagree with any part of these agreements, then you may not access the Service.

2. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years of age or have parental consent

4. Estimate Submissions

When you submit information for an estimate, you agree that:

• All information and photos you provide are accurate and truthful
• You have the right to submit the information and photos
• You will not submit false, misleading, or fraudulent information
• You understand that estimates are AI-generated and may not be 100% accurate
• You will verify estimates with qualified professionals before making decisions
• You are responsible for the accuracy of information provided

5. Subscription and Payment

If you subscribe to the Service, you agree to:

• Pay all fees associated with your subscription
• Provide accurate payment information
• Authorize automatic billing for recurring subscriptions
• Understand that subscription fees are billed in advance
• Accept that subscription fees are generally non-refundable
• Cancel your subscription according to our cancellation policy

6. Intellectual Property

The Service and its content, features, and functionality are owned by Carlucci Digital Marketing Agency (CDMA) and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the Service or its content
• Reverse engineer or attempt to extract source code
• Use our trademarks or logos without permission
• Remove any copyright or proprietary notices

7. User Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a license to:

• Use, store, and process your content to provide the Service
• Share your content with AI services (e.g., Google Gemini) for estimate generation
• Store your content securely in our systems
• Delete your content when you request account deletion

8. AI-Generated Estimates

You acknowledge and agree that:

• Estimates are generated using artificial intelligence and are not guaranteed to be accurate
• Estimates should be verified by qualified professionals
• We are not liable for decisions made based on AI-generated estimates
• Final costs may vary from estimated amounts
• Estimates are provided as a starting point, not a final quote

9. Limitation of Liability

To the maximum extent permitted by law, The Estimator and CDMA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless The Estimator, CDMA, and their officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or violation of this Agreement.

11. Account Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach this Agreement. Upon termination:

• Your right to use the Service will immediately cease
• You may request deletion of your data
• We may retain certain information as required by law
• Outstanding fees remain due and payable

12. Changes to Agreement

We reserve the right to modify or replace this User Agreement at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the new terms.

13. Governing Law

This User Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which CDMA operates, without regard to its conflict of law provisions.

14. Entire Agreement

This User Agreement, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and The Estimator regarding the use of the Service and supersedes all prior agreements and understandings.
